These are the Terms and Conditions governing the use of this service and the agreement that operates between You, the client, and the Company, Brighton Photography. These Terms and Conditions set out the rights and obligations of all users regarding the use of the service (website, photography services, purchases of digital or physical prints, or any other services provided by Brighton Photography).

Your access to and use of the services therein is conditioned on your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service. By accessing or using the service provided by Brighton Photography, you agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then you may not access the Service.

Your access to and use of this service is also conditioned on your acceptance of and compliance with the Privacy Policy of the Brighton Photography. Our Privacy Policy describes the policies and procedures on the collection, use and disclosure of your personal information when you use the Website and tells you about your privacy rights and how the law protects you. Please read our Privacy Policy carefully before using our service.

These and other provisions are laid out in full in the photography contract that must be signed upon purchase of any photography package by Brighton Photography. You, the client, agree to the following:

SERVICES PROVIDED
The photographer will fulfill their obligation of the purchased photo session in the manner they deem most appropriate, regardless of input by the client.

PAYMENT
All photo packages have a set price and are outlined here on this website, as well as on the photography contract. The client will be expected to pay an initial deposit of $50 at the time of signing the contract, as well as pay the remaining balance in full no later than 48 hours prior to the scheduled photo session. All deposits are non-refundable.

CANCELLATION
In the event of a cancellation, the client will be required to provide the photographer notice at least 24 hours in advance of the scheduled photo session. If sufficient notice is not provided outside this 24 hour window, full payment of services will still be expected of the client. In the event that the photographer needs to cancel, for whatever reason, a full refund will be transferred back to the client, INCLUDING the $50 deposit.

RESCHEDULING
Rescheduling a session, due to the time-sensitive nature of photography, will be treated the same as cancellation: a minimum 24 hour notice must be given, otherwise the full balance will be due on the original agreed upon date. The only exception is in the event of unforeseen unfavorable weather that would prevent the photo session from continuing or beginning, at which point the session may be rescheduled for a mutually agreed upon future date.

CONFIDENTIALITY
All personal information collected by Brighton Photography will be kept in confidence by the company and will not be used for any purposes other than direct contact with the client. Personal information will not be given or sold to any other entity for any purpose outside fulfilling the obligations outlined in the contract.

PROPRIETARY & INTELLECTUAL RIGHTS
Brighton Photography is the sole proprietor and retains all copyrights to all images produced. The client grants the company permission to use these images for promotional purposes on this website, as well as publishing rights to third party sites and social media platforms. The client will be granted printing rights for non-commercial use.

LIABILITY (INDEMNIFICATION)
Brighton Photography cannot be held responsible for any unforeseen costs, expenses, or losses on behalf of the client during or around the time of the scheduled photo session. Brighton Photography is also not responsible for any injuries endured during the photo session. While personal preference of the client will be considered for the creation of any photo, Brighton Photography is not contractually bound to cater to the aesthetic wishes of the client, as this is predominantly at the discretion of the photographer.

WARRANTY OF SERVICES
Brighton Photography will perform its functions and duties in a timely and professional manner up to or surpassing the industry standard.

AMENDMENTS OF CONTRACT
At no time may the client alter any provision of the contract signed without the agreement and written consent of Brighton Photography. Once the contract is signed, no further amendments may be made.

INHERENT QUALITIES OF IMAGES
The client recognizes and understands that images produced can vary in quality, color, and clarity, particularly when viewed on different screens and when printed. Brighton Photography cannot be held liable for any discoloration or changes to other inherent qualities pertaining to quality, color, and clarity of images over time.
